Terms and Conditions (EULA / Terms of Use) of the SkarbeX Application.

1. general provisions

1.1 These Regulations ("Regulations") set out the rules for the use of the SkarbeX mobile application (hereinafter: "Application").
1.2 The owner and administrator of the Application is Kamil Horst, based in Wola (43-225, Poland), e-mail: skarbexapp@gmail.com.
1.3. By using the Application, the user confirms that he/she has read these Regulations, understands their content and undertakes to comply with them.
1.4. The Regulations constitute an agreement between the user and the owner of the Application within the meaning of Article 8 of the Act on Electronic Service Provision.

2 Scope of the application

2.1 The SkarbeX application allows users to:

  • publishing photos and descriptions of finds,

  • Communication and exchange of experiences with other users,

  • Use of maps and locations,

  • Access to premium features upon subscription.

2.2 The User agrees to use the Application in accordance with the law, rules of social intercourse and these Regulations.

3 Technical requirements

3.1 In order to use the Application, an iOS or Android mobile device, an Internet connection and an active user account are required.
3.2 The Owner is not responsible for the inability to use the Application resulting from failure to meet the technical requirements.

4. user account

4.1. Creating an account on the Application requires providing an email address and accepting these Terms and Conditions and Privacy Policy.
4.2. The User is obliged to protect the login data and not to share the account with third parties.
4.3. The Owner has the right to suspend or delete the User's account in case of violation of these Terms and Conditions.

5 Rules of use and user responsibility

5.1 It is prohibited to publish content in the Application that:

  • violate the law, morality or rights of third parties,

  • are of a vulgar, abusive, racist or violence-promoting nature,

  • contain advertising, spam, or content that is inconsistent with the purpose of the Application,

  • present antiquities, weapons, ammunition, unexploded ordnance or other dangerous objects.

5.2 The user is fully responsible for all content he/she publishes.
5.3 The owner reserves the right to remove content that violates the Terms of Service or the law, as well as to block users.
5.4 The owner is not responsible for the actions or content published by users.

6 Subscriptions and payments

6.1. The Application offers access to premium features in the form of auto-renewable subscriptions.
6.2. Information about the duration of the subscription, the price and the scope of services is available in the App Store or Google Play.
6.3. Payments are made through Apple or Google platforms - the owner of the Application does not store or process users' payment data.
6..4 You may cancel your subscription at any time in the settings of your Apple ID or Google Play account.
6.5 Refunds of payments are possible only in accordance with the rules set by Apple or Google.
6.6 Non-payment or cancellation of subscription results in limited access to Premium features.

7. intellectual property rights

7.1 All elements of the Application, including code, logos, graphics and text, are protected by copyright and belong to the owner or its licensors.
7.2 You may not copy, decompile, modify or use elements of the Application in a manner contrary to its intended use.
7.3 By publishing content on the Application, you grant the owner a non-exclusive, royalty-free license to display it on the Application.

8 Accountability

8.1 The Owner makes every effort to make the Application work properly, but does not guarantee its uninterrupted or error-free operation.
8.2 The Owner is not responsible for:

  • loss of data for reasons beyond his control,

  • damages resulting from the use of the Application in a manner inconsistent with the Terms and Conditions,

  • User activities that violate the law.

9. account deletion and contract termination

9.1 You may delete your account at any time in accordance with the instructions available at:

9.2 Deletion of your account results in the termination of the agreement between you and the owner of the Application.
9.3 The owner reserves the right to delete your account in case of violation of the Terms and Conditions or the law.

10. changes to the regulations

10.1 The Owner may make changes to the Terms and Conditions, of which it will inform users in the Application or on the website.
10.2 The use of the Application after the introduction of the changes implies acceptance of the changes.

11 Applicable law and disputes

11.1 This Agreement shall be governed by the laws of Poland.
11.2 Any disputes shall be resolved by the common court having jurisdiction over the registered office of the owner of the Application.
11.3 The SkarbeX Application may be downloaded from the App Store or Google Play platforms. Apple Inc., Google LLC or their affiliates are not a party to this agreement and are not responsible for the operation of the Application.
